Data protection in the context of PSD2

The interplay of PSD2 and GDPR has raised a number of legal issues. The European Data Protection Board (EDPB) provided some clarifications in a July 2018 letter to MEP Sophie in ‘t Veld (available here). In July 2020, the EDPB issued long awaited draft guidelines on that interplay, that they consulted on (see here). The EDPB received approximately 40 sets of comments, including comments from PayBelgium and from law firm Bird & Bird. On 15 December 2020, the EDPB published its final guidelines (available here). Oran Kiazim (Senior Data Protection Advisor, Bird & Bird) and Scott McInnes (Partner, Bird & Bird) will present on those guidelines, the clarifications that they provide, and the questions that are left open. They will touch, in particular, on the legal basis for TPPs to process data, the concept of “purpose limitation”, explicit consent, silent party data, and special category data.
