Strong customer authentication in a TPP context – latest developments in light of EBA positions

The revised Payment Services Directive (PSD2) introduced a legal framework for two innovative payment services that were not previously regulated: account information services and payment initiation services. The provision of both services requires that the service provider (third party payment service provider (TPP)) have access to the payment accounts their users hold with account servicing payment service providers (ASPSPs). Since September 2019, ASPSPs must offer at least one interface that licensed TPPs can use for secure access to payment accounts in accordance with the security requirements set out in the RTS SCA & CSC. Those include a requirement to apply strong customer authentication (SCA), the performance of which is a responsibility of the ASPSP. The implementation of that requirement has given rise to various questions which the EBA has addressed in its recent opinion on obstacles under Article 32(3) of the RTS SCA & CSC. During this webinar, Scott McInnes and Julien Sad from Bird & Bird will explain the positions the EBA has taken in this respect. They will also explain the EBA’s position on the limits for TPPs to continue to use certain technologies that prevailed prior to the entry into force of PSD2 (screen scraping, reverse engineering) to access non-payment accounts in light of the SCA requirement to access payment accounts.
